BOSTON (WBZ NewsRadio) — Federal prosecutors are asking for more time to decide whether they will file a petition for a re-hearing in the case of Boston Marathon bomber Dzhokhar Tsarnaev.
Earlier this month, the 1st U.S. Circuit Court of Appeals vacated the death penalty for Tsarnaev. The court said jurors were not properly screen for the trial.

Federal prosecutors were given until Friday Aug. 14 to decide on filing a petition for a re-hearing. The Department of Justice is now asking they be given until Sept. 14 to make that decision.
The 2013 Boston Marathon bombing killed three people and injured hundreds more.
